2021年，南京的小李在被某生物科技公司录用为工程师后，因体检结果为乙肝病毒携带者，又被告知无法入职。法院审理认为：被告公司招聘前，没有对体检做出特殊要求；也无充分证据证明结构工程师岗位，是禁止乙肝病毒携带者从事的特殊岗位。因此，被告公司侵犯了小李的平等就业权，应承担精神损害抚慰金、误工费等共计10208元。目前，判决已生效。
