新修订的仲裁法自2026年3月1日起施行

新华社北京9月12日电（记者齐琪）十四届全国人大常委会第十七次会议9月12日表决通过新修订的仲裁法，自2026年3月1日起施行。

仲裁是国际通行的纠纷解决方式，也是优化营商环境、提升法治实力的重要手段。新修订的仲裁法共8章96条，健全完善具有中国特色、与国际通行规则相融通的仲裁法律制度，对于加强涉外法治建设，提高我国仲裁公信力和国际竞争力，更好服务高质量发展和高水平对外开放具有重要意义。

新修订的仲裁法规定，仲裁活动可以通过信息网络在线进行，但当事人明确表示不同意的除外。仲裁活动通过信息网络在线进行的，与线下仲裁活动具有同等法律效力。国家支持仲裁机构加强与境外仲裁机构和有关国际组织的交流合作，积极参与国际仲裁规则的制定。

为符合仲裁实践发展需要，更好打造国际商事仲裁优选地，新修订的仲裁法明确支持仲裁机构到中华人民共和国境外设立业务机构，开展仲裁活动。根据经济社会发展和改革开放需要，可以允许境外仲裁机构在国务院批准设立的自由贸易试验区、海南自由贸易港等区域内依照国家有关规定设立业务机构，开展涉外仲裁活动。

此外，新修订的仲裁法还对涉外仲裁、仲裁监督和法院支持仲裁等相关制度作了修改完善。

Xinhua News Agency,Beijing,September 12(Reporter Qi Qi)The 17th session of the Standing Committee of the 14th National People’s Congress passed the newly revised Arbitration Law on September 12,which will come into effect on March 1,2026.

Arbitration is a widely accepted international method of dispute resolution and an important means of optimizing the business environment and enhancing the strength of the rule of law.The newly revised Arbitration Law consists of eight chapters and 96 articles.It improves the arbitration legal system with Chinese characteristics and in line with international rules.It is of great significance to strengthen the construction of foreign-related rule of law,enhance the credibility and international competitiveness of China’s arbitration,and better serve high-quality development and high-level opening up to the outside world.

The newly revised Arbitration Law stipulates that arbitration activities can be conducted online through information networks,except when the parties explicitly express their disagreement.Arbitration activities conducted online through information networks have the same legal effect as offline arbitration activities.The state supports arbitration institutions in strengthening exchanges and cooperation with foreign arbitration institutions and relevant international organizations and actively participating in the formulation of international arbitration rules.

To meet the needs of the development of arbitration practice and better build a preferred place for international commercial arbitration,the newly revised Arbitration Law clearly supports arbitration institutions in setting up business institutions and conducting arbitration activities outside the territory of the People’s Republic of China.According to the needs of economic and social development and reform and opening up,foreign arbitration institutions may be allowed to set up business institutions and conduct foreign-related arbitration activities in free trade pilot zones,Hainan Free Trade Port and other areas approved by the State Council in accordance with relevant national regulations.

In addition,the newly revised Arbitration Law has also made modifications and improvements to the relevant systems of foreign-related arbitration,arbitration supervision and court support for arbitration.

On September 10,2025,as one of the series of activities of the 13th China Arbitration Week,the seminar on“New Trends in the Energy Industry and Energy Dispute Resolution”was successfully held in Beijing.The seminar was organized by Beijing Jingdu Law Firm,with the China International Economic and Trade Arbitration Commission(CIETAC)and the New Energy Overseas Development Alliance as guiding units.Industry experts and practitioners from well-known domestic and international law firms,engineering consulting institutions,enterprises,and universities gathered together to focus on the dispute resolution and risk challenges faced by Chinese-funded enterprises in the overseas development of the energy field.They discussed how to grasp the latest trends in the energy field in today’s complex geopolitical environment,ensure the smooth progress of energy projects,promote the transformation and development of the energy industry,and effectively prevent and resolve energy disputes.

During the seminar,participants engaged in an in-depth discussion of dispute resolution and risk management strategies in the energy sector,providing valuable insights for industry development.The successful hosting of the seminar has created an efficient communication platform for the energy industry and injected new momentum into its stable development.

CIETAC has released the Annual Report on International Commercial Arbitration in China (2024–2025), the Selected Cases of Construction Engineering Arbitration, and the Study on Arbitration Systems in Latin American Countries.

香港国际仲裁中心（“HKIAC”）发布了关于香港国际仲裁中心仲裁规则下仲裁条款兼容性的实践指引（“实践指引”）。

该实践指引阐述了在2018年和2024年香港国际仲裁中心仲裁规则（“HKIAC规则”）下，HKIAC在多方、多合同情形中评估仲裁条款兼容性的一般做法，并解释了在这些情形下HKIAC组成仲裁庭的一般方法。

On September 16,2025,the China International Economic and Trade Arbitration Commission(hereinafter referred to as“CIETAC”)held a press conference in Beijing.Wang Chengjie,Vice Chairman and Secretary-General of CIETAC,released the Annual Report on International Commercial Arbitration in China(2024–2025)(hereinafter referred to as the“Annual Report 2024–2025”),the Selected Cases of Construction Engineering Arbitration(hereinafter referred to as the“Selected Cases of Construction Engineering”),and the Study on Arbitration Systems in Latin American Countries(hereinafter referred to as the“Latin American Study”)at the conference.The press conference was presided over by Gu Yan,Vice President of the Arbitration Institute of CIETAC.

Secretary-General Wang Chengjie pointed out that,in order to better implement the requirements of the Third Plenary Session of the 20th Central Committee on cultivating a number of world-class arbitration institutions,and to promote the construction of China as a new global destination for international commercial arbitration,CIETAC has decided to continue compiling and publishing the“Annual Report 2024–2025”on the basis of a 10-year accumulation.It has also selected typical cases from the construction engineering arbitration cases that CIETAC has handled in recent years to conduct research and compile the“Selected Cases of Construction Engineering.”In addition,with the gradual rise of the“Global South”countries and the continuous expansion of China-Latin America economic and trade exchanges under the framework of the“Belt and Road Initiative,”CIETAC has organized research and compilation of the“Latin American Study”based on its previous research on arbitration systems in countries along the“Belt and Road.”The aim is to further promote the improvement of China’s arbitration system,the development of the industry,and information exchange through research,and to enhance China’s credibility and influence on the international commercial arbitration stage.

为充分响应“统筹国内国际两个大局”“统筹推进国内法治和涉外法治”的国家部署，助力营造市场化、法治化、国际化营商环境，更好满足市场主体多元争议解决服务的新期待，提高中国仲裁的国际影响力和公信力，北京仲裁委员会/北京国际仲裁院（以下称“北仲”）制定了《北京仲裁委员会/北京国际仲裁院国内仲裁规则（征求意见稿）》（以下称国内规则）、《北京仲裁委员会/北京国际仲裁院国际仲裁规则（征求意见稿）》（以下称国际规则）（文末可下载全文）。经专项调研与多轮修改，现面向社会公开征求意见。通过本次规则修订与完善工作，北仲将形成“1+1+N”的规则体系，即“一部国内仲裁规则+一部国际仲裁规则+多部特别规则”。其中，国内、国际分立的规则设置，可进一步满足市场主体对专业化、国际化仲裁服务的多元需求；多部特别规则既包括在程序上有特殊安排的规则，如调仲对接快速程序规则、建设工程争议评审规则等，也包括用于特定专业领域、适用于该领域纠纷解决特色的规则，如国际投资仲裁规则等。

In full response to the national deployment of“coordinating the domestic and international situations”and“promoting domestic rule of law and foreign-related rule of law in a coordinated manner,”and to help create a market-oriented,law-based,and international business environment,better meet the new expectations of market entities for diversified dispute resolution services,and enhance the international influence and credibility of Chinese arbitration,the Beijing Arbitration Commission/Beijing International Arbitration Center(hereinafter referred to as“BAC”)has formulated the Domestic Arbitration Rules of the Beijing Arbitration Commission/Beijing International Arbitration Center(Draft for Public Comments)(hereinafter referred to as the Domestic Rules)and the International Arbitration Rules of the Beijing Arbitration Commission/Beijing International Arbitration Center(Draft for Public Comments)(hereinafter referred to as the International Rules)(the full text can be downloaded at the end of the article).After special research and several rounds of revision,the draft is now open to public comments.Through this revision and improvement of the rules,BAC will form a 1+1+N rule system,that is,“one set of domestic arbitration rules+one set of international arbitration rules+multiple special rules.”The separate domestic and international rules can further meet the diversified needs of market entities for professional and international arbitration services.The multiple special rules include not only rules with special procedural arrangements,such as the mediation-arbitration connection fast-track procedure rules and construction dispute review rules,but also rules for specific professional fields and applicable to the characteristics of dispute resolution in those fields,such as international investment arbitration rules.

On the afternoon of September 25,2025,the inauguration ceremony of the China(Beijing)Securities and Futures Arbitration Center,as well as the launch of the Securities and Futures Arbitration Rules and the top ten classic arbitration cases,was successfully held at the Zhengda Center in Beijing.The China(Beijing)Securities and Futures Arbitration Center was initiated and established by the Beijing Arbitration Commission/Beijing International Arbitration Center(hereinafter referred to as"BAC"),marking a key step for Beijing in building a dispute resolution system in the securities and futures field and enhancing the legalization level of the capital market.

The establishment of the China(Beijing)Securities and Futures Arbitration Center is an important milestone since BAC's establishment 30 years ago.In the future,the center will rely on Beijing's resource advantages as the national financial management center,actively connect with international arbitration standards and practical experience,and build itself into a professional and high-level securities and futures dispute resolution platform based in China and facing the globe.It will continuously enhance China's influence and voice in the field of international financial arbitration and contribute arbitration wisdom and strength to the high-quality development of the capital market and the construction of the international financial governance system.

香港国际仲裁中心（“HKIAC”）与巴西-加拿大商会仲裁与调解中心（“CAM-CCBC”）续签了谅解备忘录（MoU），重申了双方最初在十多年前建立的合作承诺。续签的谅解备忘录于2025年8月12日在一个虚拟仪式上签署，此前双方曾于2024年5月在香港举行的国际商事仲裁理事会（ICCA）大会期间进行了面对面的讨论。

此次合作的加强反映了亚洲与拉丁美洲之间日益增长的经济联系。作为全球趋势的一部分，两个机构在国际案件中对亚洲和拉丁美洲籍仲裁员的需求也在不断增加。

The Hong Kong International Arbitration Centre(“HKIAC”)and the Center for Arbitration and Mediation of the Chamber of Commerce Brazil-Canada(“CAM-CCBC”)renewed their Memorandum of Understanding(MoU),reinforcing their commitment to collaboration initially established over a decade ago.The renewed MoU was signed during a virtual ceremony on 12 August 2025,following in-person discussions held in Hong Kong during the ICCA Congress in May 2024.

The renewed cooperation reflects the growing economic ties between Asia and Latin America.As part of a global trend,both institutions have also seen a rising demand for arbitrators of Asian and Latin American nationality in international cases.

仲裁裁决驳回了中国某公司在瓜亚萨明交通解决方案案中对厄瓜多尔公司的巨额索赔

The arbitral award dismissed the substantial claim made by a Chinese company against an Ecuadorian company in the Guayasamín Traffic Solution case.

基多-国家总检察院（PGE）于昨日（9月22日）宣布，波哥大商会仲裁庭作出对厄瓜多尔有利的裁决。此前，中国某公司对基多大都会交通与公共工程公司（EPMMOP）提起国际仲裁程序。

此次仲裁争议围绕2016年签署的瓜亚萨明交通解决方案项目的战略联盟合同展开，该项目最终未能实施。

9月19日，仲裁庭全盘驳回了中国公司提出的索赔申请，该公司原本要求厄方赔偿超过4000万美元。国家总检察院牵头进行辩护，并得到了国际律师事务所克拉克·希尔（Clark Hill PLC）的支持，最终认定中国公司的索赔并无依据。

仲裁庭认定基多大都会交通与公共工程公司并未违反合同义务，这也是其完全驳回索赔申请的原因。该裁决具有重要意义，不仅支持了厄瓜多尔公共机构的立场，还避免了国家遭受重大经济损失。

瓜亚萨明交通解决方案项目自提出以来就争议不断，由于技术和社会层面的质疑，该项目最终未能实施。

Quito-The Attorney General's Office(PGE)reported yesterday,September 22,that the BogotáChamber of Commerce Arbitral Tribunal issued a ruling favorable to Ecuador.It was in the international proceeding initiated by a Chinese company against the Metropolitan Public Company for Mobility and Public Works(EPMMOP).

The controversy revolved around the strategic alliance contract signed in 2016 for the failed Guayasamín Traffic Solution Project.

On September 19,the Tribunal decided to reject in its entirety the claim filed by the Chinese company,which sought compensation of over 40 million.The defense was led by the PGE,with the backing of the international law firm Clark Hill PLC,and concluded that there were no grounds for the claim.

The tribunal found that EPMMOP did not breach its contractual obligations,which led to the complete dismissal of the claim.The ruling sets an important precedent,as it not only supports the position of Ecuadorian public entities but also avoids a significant financial impact for the country.

The Guayasamín Traffic Solution case has been the subject of multiple controversies since its inception,due to technical and social questions that ultimately prevented its implementation.
