据了解,目前,两位AI演员已在社交媒体抖音、小红书开通账号,宣称将分享“日常”并与网友互动。
On Wednesday, Yaoke Media unveiled Qin Lingyue and Lin Xiyan, two AI-powered virtual actors, and announced plans to release its first drama series featuring the digital talent. Accounts on social media platforms Douyin and Xiaohongshu have also been registered for the pair, where they will share "daily life" content and interact with followers.

然而,消息一出,不少网友直言,根本不想看AI演电视剧,觉得 “假人感太重、没有灵气”。

还有网友指出,这两位AI演员的长相撞脸多位明星,五官、神态甚至声音都与几位艺人高度相似,瞬间引发不少网友抵制:
The announcement was met with widespread skepticism. Many users balked at the idea of watching AI perform in scripted series, arguing that the digital figures lack the emotional depth and authenticity of human actors. One user wrote that they felt "too artificial, with no soul and no spark".

Others noted that the AI actors bear an uncanny resemblance to several established celebrities, in both facial features and vocal tone. The similarity has prompted calls for a boycott, with critics accusing the company of creating unauthorized digital replicas of real performers.

律师:或涉嫌侵权
据中青报·中青网消息,北京德和衡律师事务所副总裁、高级权益合伙人陈燕红对记者表示,AI演员“撞脸”明星,即未经许可使用AI生成的与明显高度相似的面孔进行商业活动,存在的法律风险,可能涉及侵犯肖像权,在特定情况下还可能构成不正当竞争。
Legal experts have also weighed in on the controversy. Chen Yanhong, a partner at Beijing DHH Law Firm, told China Youth Daily that using AI-generated faces that closely resemble recognizable celebrities for commercial purposes could constitute a violation of portrait rights. In some cases, she added, it may also amount to unfair competition under Chinese law.
若AI生成的虚拟面孔足以使一般公众能够明确、无误地识别出其所对应的特定明星时,该虚拟形象就可能落入了该明星肖像权的保护范围。即使AI声称是“合成”或“虚构”,但只要其与某明星的面部特征、神韵具有高度、稳定的指向性,可能导致公众误认为明星,使用该AI形象就可能构成“利用信息技术手段”制作并使用了他人的肖像。在这种情况下,使用AI演员“撞脸”明星,就存在侵犯肖像权的法律风险。
陈燕红强调,使用AI演员“撞脸”明星,还可能构成不正当竞争行为。《反不正当竞争法》第七条规定,经营者禁止擅自使用他人有一定影响标识的混淆行为。如使用该AI明星形象的知名度,在相同或类似领域进行商业宣传、直播带货等,误导消费者认为其与明星存在代言、合作等特定联系,从而获取不正当的交易机会,还可能构成不正当竞争。
AI生成短剧盗用模特摄影作品被下架
随着AI技术广泛应用,此类侵权行为愈发普遍。
近日,有网友反映,一部播放量超2300万的AI生成短剧《鲛珠引》,疑似盗用摄影师原创作品的模特形象与妆造,引发侵权争议。该作品模特马女士表示,剧中使用的造型为自己与摄影师的原创。经马女士维权投诉,目前该AI短剧已被平台下架。

针对此事,上海申浩律师事务所顾玺曦律师称,短剧制作方可能涉及肖像权侵权与著作权侵权行为。
律师提醒,若发现AI侵权行为,应第一时间通过网页截图、录屏等方式固定证据,然后尽快去寻找律师,寻求法律帮助。
Experts advised that anyone who suspects their likeness has been used without permission should preserve evidence, such as screenshots or screen recordings, and seek legal counsel.
