被“怼脸拍”后打粉丝？一男艺人高铁站行为引热议！

12月30日，话题“灵超机场打粉丝”登上热搜第一，引发广泛关注 。 事后，灵超所在经纪公司回应称，事件发生于高铁站。

Chinese singer Ling Chao has come under public scrutiny after getting into a physical confrontation with a female fan who was filming him at close range, bringing renewed attention to "sasaeng" stalking behavior.

据中国蓝新闻，有网友称，事发时该女粉丝一直对着艺人灵超拍照。

视频显示，两名女生拿着手机怼脸拍灵超，灵超情绪出现波动，与女生发生冲突。

A video circulated online on Tuesday showing two young women filming Ling at close range at a railway station, during which he became visibly emotional and clashed with one of them.

灵超所在的经纪公司称，灵超仅存在抢夺对方手机并摔坏屏幕的行为，未发生任何肢体暴力（如拽头发、背摔等）。双方已就手机损失协商赔偿。

公司表示，涉事女方为“私生（sasaeng）”（源自韩语，最早出现于韩国明星文化中，由“私生活的”缩写而成，指通过跟踪、偷拍等手段侵犯明星隐私的极端粉丝群体），有长期骚扰行为。

His management company later said the incident occurred at a high-speed rail station, stating that Ling grabbed the woman's phone and smashed its screen but did not engage in further physical violence, and that compensation had already been agreed. The agency also claimed the woman was a "sasaeng fan", alleging she had repeatedly harassed him.

对此，有网友认为，理解抵制“私生”行为，但不支持以动手的方式解决问题。

也有网友认为，“私生”根本不算真正的粉丝，支持抵制。

Online opinion remains divided. Some netizens said it is understandable for artists to resist invasive behavior but argued that violence is not appropriate, while others insisted "sasaengs" are not real fans and voiced support for tougher measures to protect celebrities' privacy.

据此前报道，灵超被曝曾多次与“私生”发生冲突。据济南交通广播报道，7月17日，灵超遭遇“私生粉”近距离怼脸拍摄，抢过对方手机并丢在地上。

10月，灵超曾喊话“私生粉”法庭见，称被“私生粉”报复性回击，包括偷拍、造谣、煽动舆论颠倒是非黑白等。

对此，北京学天律师事务所蔡雅奇律师表示，公众人物被他人当众拍摄，可以进行正当防卫，但方式不能是“打人”，否则就超出了正当维权的范畴。任何人都有隐私权，都有不被他人偷拍的权利。面对这种偷拍行为，正常的维权方式可以包括但不限于口头警告、要求对方赔礼道歉、要求对方立即删除拍摄内容等。

浙江丰国律师事务所的陈松涛律师提醒，艺人作为青少年群体偶像，其应对冲突的方式具有社会导向性。灵超摔手机行为若被效仿，可能引发“以暴制私”的错误价值观传播。

Legal experts say public figures have the right to protect their privacy but must do so within the law. Cai Yaqi, a lawyer from a Beijing law firm, noted that while celebrities may act against unauthorized filming, violence exceeds legitimate protection, suggesting warnings, deletion requests or legal action instead.

Zhejiang-based lawyer Chen Songtao added that violent responses risk setting a harmful example for young audiences.

“私生”乱象频发

这些事件也暴露出，近年来，“饭圈”文化的盲目狂热催生出种种乱象。“私生”极端追星行为频发，艺人的个人隐私屡遭侵害。
今年以来，就有多位艺人公开谴责“私生”行为，呼吁大家理智追星。

北京大成（南京）律师事务所律师晋虤表示，新修订的《治安管理处罚法》中明确，有滋扰、纠缠、跟踪行为的，经公安机关负责人批准，可以责令其一定期限内禁止接触被侵害人，相关行为禁令为法案新增内容，在拘留处罚与不拘留之间形成缓冲地带。

《治安管理处罚法》第五十条规定，采取滋扰、纠缠、跟踪等方法，干扰他人正常生活的处五日以下拘留或者一千元以下罚款；情节较重的，处五日以上十日以下拘留，可以并处一千元以下罚款。

以粉丝滋扰明星私生活为例，如其滋扰强度尚未达到需由公安机关立即执行拘留处罚时，可先向行为人发出行为禁令。在屡教不改，违反行为禁令的情况下，再启动拘留措施。

Meanwhile, legal measures against harassment have tightened under China's revised Public Security Administration Punishments Law, which allows fines, detention or contact bans for stalking and harassment.

Article 50 states that such behavior can lead to up to five days' detention or fines, and up to ten days in serious cases. Authorities may also issue behavioral injunctions first, with tougher penalties for violations.
