近日,消费者黄女士(化名)称,自己在广东一家海鲜大排档,遭遇“茶位费刺客”。
黄女士表示,他们一行13人,其中有5个小孩(包含两名婴儿),在广东某海鲜大排档总共消费了3525.2元。
查看账单时,她发现大排档收取了13份茶位费。她质疑:8个月大的婴儿既未使用碗筷,也未饮用茶水,为何还要收费呢?账单显示,餐具共13份,单价3元,总计39元。
A consumer surnamed Huang in Guangdong province said she encountered a "tea fee trap" at a local seafood restaurant. Her group of 13, including two infants, spent 3,525.2 yuan, with tea fees for 13 people listed on the bill.
Huang questioned why an 8-month-old baby, who neither used tableware nor drank tea, was charged.

黄女士还提到,餐厅涉嫌“宰客”:海鲜称重使用的黑色塑料袋,一半都是水分;一顿饭3000块,基本都是便宜海鲜。她要求店家退回未使用的茶位费,并按市场价退回多收的餐费,遭到拒绝。
She also accused the restaurant of overpricing, alleging that seafood was weighed with water-filled bags and that most dishes were inexpensive despite a 3,000-yuan bill.

据@黑猫投诉9月15日消息,经过跟进曝光后,黄女士称商家第一时间联系自己道歉,并按照市场价退回了餐费。
After her complaint appeared on the consumer platform Black Cat Complaints, the restaurant apologized and refunded the disputed charges.
记者注意到,第三方平台显示,该餐厅目前已暂停营业。

对此,广东省消委会工作人员回应称:“广东这边有饮茶习俗,大多数餐饮企业提供消毒碗筷和茶水服务,因此茶位费一直普遍存在。”但她同时强调,尽管能够收取茶水费,但依据《中华人民共和国消费者权益保护法》相关规定,在收取茶水费之前应当告知消费者。“若未提前告知,收费不合理,消费者可拒付。”
该工作人员还指出,即便商家已提前明确告知会收取茶位费,未享受服务的婴幼儿也不应被收取茶水费。“小孩如果没有用,应该可以协商,可以退。可以让他把两个小孩的费用退掉。”工作人员建议,消费者如果碰到类似情况,可以与商家协商,协商不成可以拨打12315进行投诉。
A representative from the Guangdong Consumers Council said tea fees are common in the region due to local customs but must be clearly disclosed under China's consumer rights protection law. The representative added that infants who do not use the service should not be charged.
不少网友反映,遭遇过类似情况,还有许多网友呼吁监管部门整治茶位费乱收费现象。

律师提醒
上海邦信阳(武汉)律师事务所罗胜律师表示,茶位费应在菜单、店内醒目位置公示或提前主动告知。未告知即可视作不合理收费,消费者有权拒绝支付。他还补充,“即便商家尽到告知义务,对完全没有消费能力的婴儿按人头收费,仍属不合理行为。”
Attorney Luo Sheng echoed this view, stressing that while tea fees must be disclosed, charging infants with no consumption ability is unreasonable.

如今,茶位费收得是越来越泛滥,早茶店收,很多普通餐厅、大排档也收。不管你喝不喝茶,这钱都照收不误,这明显就变味了,有一些收法就属于强制消费、“霸王条款”这一类的消费陷阱了。
在餐饮行业竞争激烈的今天,商家更应该靠优质的菜品和服务吸引顾客,而不是靠这种不合理收费来增加收入。这种短视行为,不仅损害了消费者权益,也砸了自己的招牌,得不偿失。
An editorial further criticized the practice, calling tea fees a form of forced consumption and "predatory clauses", warning that such practices harm consumers and damage restaurants' reputations.
