2023年9月22日一次商务酒宴,作为公司销售总监的崔某丽受公司指派赴杭州出差,期间参加商务宴请后醉酒,遭到公司实控人(总经理)王某性侵。
在经历一段时间的断片、应激、自我怀疑后,崔某丽于当年10月3日前往事发酒店调取监控并与酒店值班人员一一沟通取证,回忆起当日部分细节,识破王某的谎言以及对她可能实施性侵的情况,并拨打110报警。
A sales director surnamed Cui was sexually assaulted by her company's general manager, Wang, after a corporate banquet during a business trip to Hangzhou, Zhejiang province, on Sept 22, 2023.
After a period of memory loss, trauma and self-doubt, Cui obtained hotel surveillance footage and collected witness testimony, exposing Wang's lies and confirming the assault. She reported the incident to police on Oct 3, 2023.

在刑事阶段,王某团队曾两次求崔某丽谅解无果。法庭上,王某坚持无罪辩护,声称崔某丽在监控拍到的公共区域处于醉酒状态,但进入房间后已清醒,且是主动勾引,试图否认性侵事实。
但是,事发酒店监控录像记录了崔某丽醉酒状态、被王某带入房间及后续在走廊的状态等关键画面,酒店保安、前台工作人员的第三方证词,以及隔壁房客恰巧录下始发声音,为案件提供相对完整的证据链。
2024年4月,王某因强奸罪被判刑。本以为刑事案件的胜利,终会让事件向好发展,但工伤认定的过程并不容易。
Wang claimed Cui was conscious and initiated the encounter. However, surveillance video, hotel staff accounts, and audio recordings from a neighboring guest provided a solid chain of evidence. He was convicted of rape in April 2024.
刑事判决书明确崔某丽遭受侵害的事实,这一判决成为她主张工伤的关键依据——据最高法行政审判庭的答复意见,职工因工外出期间遭受意外伤害,符合“因工作原因”范畴的,应认定为工伤。
2024年4月18日,在崔某丽准备申报工伤之际,公司以“未按规定请假、旷工”为由解除劳动合同,并拒绝承认工伤。原先支持她的直属女上司也站在了她的对立面,劝她“以公司为重”。
Cui then sought to have her trauma recognized as a workplace injury, citing a Supreme People's Court opinion that employees harmed while on business trips should be covered by occupational injury rules. Just before she filed, the company terminated her for "absenteeism" and rejected her claim.
愤怒之余,崔某丽先后提起劳动仲裁和诉讼,要求公司继续履行合同并支付工伤待遇。
精神伤害的工伤认定标准是本案的关键之处。“国家对于精神伤害的要求比较严格,需要拿到专业的精神卫生中心医院的诊断证明,而专业精神卫生中心医院的诊断证明必须进行至少一个系统性的治疗(12次或者3个月以上治疗)。”事发后,崔某丽出现严重失眠和噩梦,并于固定三甲医院开取相关辅助药物,并未在规定医院接受系统治疗。
为此,2024年4月,她开始在安定医院接受系统治疗,历经12次心理咨询和近三个月药物治疗后,同年7月9日拿到专家会诊的正式诊断。
2024年11月4日经天津市津南区劳动能力鉴定委员会鉴定:崔某丽所患创伤后应激障碍与2023年9月22日的创伤性事件存在直接因果关系,为工伤认定的突破提供了有力证据。
She was later diagnosed with post-traumatic stress disorder (PTSD) at Beijing Anding Hospital. In November 2024, a local labor appraisal committee in Tianjin confirmed her PTSD was directly caused by the assault, paving the way for recognition of her case as a work-related injury.
2024年12月3日,崔某丽收到了天津市津南区人社局出具的《认定工伤决定书》。《决定书》显示,此事故伤害符合《工伤保险条例》第十四条(五)项规定,属于工伤认定范围,予以认定为工伤。因不服工伤认定,公司方于2025年1月,提起行政诉讼。
今年3月24日,天津市津南区劳动人事争议仲裁委员会认定公司构成违法解除劳动合同并裁决其继续履行劳动合同,以及支付停工留薪期工资等各项费用共计113万元,该事件成为国内首例获工伤认定的职场性侵事件。对此,公司方同样不认可,提出上诉。
On Dec 3, 2024, Tianjin authorities officially recognized Cui's trauma as an occupational injury. The company contested the ruling, but courts upheld it and in March 2025 ordered her reinstatement along with 1.13 million yuan in compensation.
同年5月,工伤认定案再次开庭,庭上出现了王某出具的一份笔录,但并未改变最终结果,7月16日工伤案宣判,判决驳回公司诉讼请求。
今年8月11日,崔某丽通过社交平台称,涉事公司未在规定时间内提起上诉,意味着此前法院判决已生效,她所受的伤害被认定为工伤。由此,她成为中国首例获工伤认定的职场性侵案受害人。
On Aug 11, Cui announced that the judgment had taken effect, making her the first workplace sexual assault victim in China to receive such recognition.
案件终审后,崔某丽开专栏、拍视频,把流程、证据清单、心理援助电话做成“求生地图”;走进校园、企业,告诉女孩们“沉默才是帮凶”。
“我想告诉职场女性,遭遇侵害不是耻辱,沉默才会让施暴者更猖狂。”
她希望通过自己的案例,推动企业完善职场保护机制,让权力不对等不再成为性侵的温床。
Following the ruling, Cui began sharing her story online and in public talks, offering a "survival map" of evidence checklists and mental health resources. She urged women not to remain silent and called on companies to strengthen workplace protections so that power imbalances no longer enable abuse.
"I want working women to understand that being assaulted is not shameful — it is silence that allows abusers to grow bolder," she said.
作为国内第一例获工伤认定的职场性侵事件,崔某丽的胜诉为类似案件提供了重要参考。法院在判决中明确,“因公外出期间的休息场所属于工作场所的延伸”“精神伤害可纳入工伤范畴”“醉酒状态不免除企业的工伤责任”,这些认定都在一定程度上突破了现有制度的模糊地带。
The case set a legal precedent by affirming that hotel rooms during business trips are extensions of the workplace, that psychological trauma can be covered by occupational injury protections, and that intoxication does not absolve employers of liability. These determinations have, to some extent, helped clarify previously ambiguous areas of the law.
