根据教育部留学服务中心的规定，留学回国人员不分应届和往届，一律没有三方协议，是否为应、往届生，由用人单位界定。一般通过以下两种方式:
1、根据是否缴纳社保界定
2、根据毕业或学位认证时间界定(最终还是以企业要求为准)
