汽车行驶中，后排座椅放倒当床睡，违法吗？

五一假期坐车出行时，你是否也曾想过放倒后排座椅，在车内小憩片刻？

在不少人分享的自驾视频里，车辆高速行驶途中，有人将后排座椅放倒，与后备箱连通拼成一张“床”，铺上被褥躺卧休息。

With the May Day holiday travel season in full swing, many travelers have asked whether it is safe, or even legal, to recline the back seat in a car and rest during a long drive.

Videos circulating online show passengers folding down rear seats to create makeshift beds connected to the trunk, complete with blankets and pillows, while the vehicle is moving at high speed.

那么，车辆行驶时，乘车人躺卧休息，是否属于违法行为？将车后排座椅改造成床铺，是否允许？

对此，《法治日报》律师专家库成员、北京市法大律师事务所合伙人段慧传律师表示，法律没有明文禁止乘客躺卧，该行为本身不违法，但躺卧不等于无法律风险。

若在车辆驾驶途中，乘客躺卧未正确使用安全带，或干扰了驾驶员，例如乘客躺卧时身体延伸至驾驶区域，妨碍了驾驶员操控车辆、影响其视野，则涉嫌违反道路交通安全法第五十一条及第六十六条的规定，将面临警告或者5元以上50元以下罚款。

According to Duan Huichuan, a member of the Legal Daily expert panel, there is no explicit legal prohibition against passengers lying down in a vehicle. However, this does not mean the behavior is free of risks. If a passenger lies down without properly wearing a seatbelt or if their posture interferes with the driver, it may violate Articles 51 and 66 of China's Road Traffic Safety Law, which could result in a warning or a fine ranging from 5 to 50 yuan.

山西省公安厅交通管理总队高速五支队交警称，机动车在高速行驶过程中，乘车人躺卧的风险极大，车辆急刹或碰撞时，人会被直接抛射，极易造成伤亡；若因此违法情形引发事故，保险公司可拒绝理赔。

Traffic police from the Shanxi Provincial Public Security Department warn that lying down at high speeds is extremely dangerous. In the event of sudden braking or a collision, an unrestrained passenger could be thrown from the seat and suffer serious injuries. In addition, if an accident is linked to such behavior, insurance companies may refuse compensation.

如果遇到乘车人躺卧的情况，将罚款5元，责令整改并教育。若乘车人躺卧且未系安全带，一般罚款5元，并责令恢复座椅原样；驾驶人未尽提醒、劝阻义务的，处警告或20元以上200元以下罚款；驾驶人搭载未成年人的，从重处罚，责令整改并教育。

If a passenger is found lying down, they may face a fine of 5 yuan and be ordered to correct the behavior. If the passenger is also not wearing a seatbelt, the same penalty applies, and the seat must be restored to its original position.

Drivers who fail to remind or stop passengers may receive a warning or a fine of 20 to 200 yuan. Penalties are stricter if minors are involved, with drivers required to rectify the situation and undergo safety education.

另外需要注意，私自将车内座椅改装成床铺的，属于非法改装。

小型客车、客运车私改床铺的，将面临500元罚款，责令恢复原状；客运车硬座改卧铺，将面临500元以上2000元以下罚款、记6分的处罚；货车严禁客货混装、改装床铺载人，违者将面临500元以上2000元以下罚款、记3分的处罚，同时强制整改。

律师、交警提醒

无论驾驶员或乘车人需要休息，应等车辆驶入服务区、停车场等合法区域，停好车后再躺卧。

Whether driving or riding as a passenger, those who need to rest should wait until the vehicle reaches a designated safe area, such as a service area or parking lot, before lying down for a rest.

但需要注意，严禁在高速公路或城市快速路的应急车道停车休息，根据《道路交通安全违法行为记分管理办法》规定，在高速公路或者城市快速路上违法停车的，一次记9分。
