4月8日,针对跳水运动员全红婵遭受网络暴力一事,其所属的广东省二沙体育训练中心发文表示已报警,并将通过法律途径坚决追究网暴者责任。国家体育总局游泳运动管理中心随后也发表声明,称坚决支持通过法律手段维护运动员合法权益,坚决抵制畸形“饭圈”文化侵蚀。
Chinese sports authorities have issued a coordinated response condemning online abuse and toxic fan culture after three-time Olympic gold medalist Quan Hongchan was targeted by cyberbullying and misinformation, vowing legal action and stronger protections for athletes.
In separate statements released on Wednesday, the Ersha Sports Training Center of Guangdong and the swimming management center of the General Administration of Sport of China said they had launched investigations into the incident and reported relevant cases to police.
前不久,全红婵在接受媒体采访时含泪恳求“不要再骂我了”的画面,让很多人感到唏嘘,足见网暴对运动员身心健康带来的负面影响。此次训练中心报警,正是对这一恶性伤害最直接的法律回应。
据媒体报道,全红婵遭网暴事件可能涉及一个微信群,其规模达200余人,群公告明文标注“禁止攻击其他运动员(全红婵除外)”,群内长期存在针对全红婵的侮辱性外号与人身攻击言论。
According to reports, the abuse may have originated from a WeChat group of over 200 members. Its pinned rule read: "Do not attack other athletes — except Quan Hongchan". Derogatory nicknames and personal attacks against her were routine in the group.
这一细节令人不寒而栗:本是用来群聊的社交工具,却异化为公开的侮辱场所。从法律角度看,这并非普通的“口嗨”,而是有明确指向的人格侵害。民法典规定,任何组织或者个人不得以侮辱、诽谤等方式侵害他人的名誉权。不特定关系人组成的微信群具有公共空间属性,群成员在此类微信群中发布侮辱、诽谤、污蔑或者贬损他人的言论,可能构成名誉权侵权,应承担法律责任。
根据《互联网群组信息服务管理规定》,互联网群组建立者、管理者应当履行群组管理责任,依据法律法规、用户协议和平台公约,规范群组网络行为和信息发布,构建文明有序的网络群体空间。“两高一部”联合印发的《关于依法惩治网络暴力违法犯罪的指导意见》规定,网络服务提供者发起、组织的实施网络暴力违法犯罪,依法从重处罚。根据上述规定,群主对群成员负有管理职责。若调查证实该微信群的群成员发表不当言论侵犯他人合法权益或公共利益的,群主若未尽管理职责,亦应承担相应侵权责任,若情节严重,还可能面临治安处罚甚至刑事责任。
This turns a social chat tool into a public space for humiliation. Under Chinese civil law, insulting or defaming someone in a group with no pre-existing personal ties can violate the right to reputation. Such groups are considered quasi-public, and members who post abusive content may face legal liability.
Group administrators also bear responsibility. Regulations require them to manage member conduct; failure to do so can lead to civil liability, administrative penalties, or even criminal charges in serious cases. Authorities have now stepped in, and a resolution is expected soon.
相信在有关部门介入之后,网暴全红婵事件很快会有结果。但也要清醒地认识到,清朗网络空间的构建,从来不是办理一件有影响力的案件就能一劳永逸。这场网暴背后不仅暴露出畸形“饭圈”文化对体育圈生态的侵蚀,更揭露出网暴治理的深层次困境——低成本施暴与高成本维权之间的失衡,让不少本应被追责的网暴行为游离在法律管制之外。
如何向屡禁不止的网暴行为说“不”?网络平台要履行好监管责任,不以“流量”为由牺牲个人利益、助长极端情绪,从源头上切断“饭圈”毒瘤的传播链条。司法机关要加大惩治力度,提高违法成本,让网暴者痛到不敢再犯,并明确微信群、微博群、贴吧群等各类互联网群组建立者、管理者的责任边界,让“半封闭空间”不再享有隐形的侵权豁免。
Yet one case alone won't clean up cyberspace. The incident reveals how toxic fan culture has invaded sports — and a deeper imbalance: cyberbullying costs little to commit but much to fight. Many offenses remain beyond the law's reach.
To stop this, platforms must regulate content without chasing traffic at the expense of individual rights. Courts and police must raise the cost of abuse and clarify administrators' duties — so that semi‑closed online spaces no longer enjoy de facto immunity.
只有将网暴的违法成本从“纸面”落到“现实”,公众人物的人格权保护才能真正获得法治的刚性托底。希望通过对全红婵遭网暴事件的依法处置警醒世人,网暴者躲在屏幕后“法不责众”的幻想,在法律面前没有容身之处。
Only when legal consequences move from paper to practice can public figures like Quan be truly protected. This case should serve as a warning: hiding behind a screen offers no escape from the law.
