房产面积误差处理方式有哪些

1、按套(单元)计价的处理方式

在商品房现房销售中，以“套(单元)”计价，若引起面积误差纠纷，一般尊重当事人在合同订立时对按套计价方式的合意。

商品房预售时，以“套(单元)”计价，房地产开发企业应在合同中附所售房屋的平面图，并约定误差范围。房屋交付时，套型与设计图纸一致，相关尺寸在约定误差范围内，维持总价款不变;若套型与设计图纸不一致或相关尺寸超出约定误差范围，合同未约定处理方式的，买受人可退房或与房地产开发企业重新约定总价款，买受人退房的，由房地产开发企业承担违约责任。

2、按面积计价的处理方式

合同有约定的：按照合同约定处理。例如合同中可能约定面积误差比在一定范围内的处理方式，以及超出该范围的不同处理办法等。

合同没有约定或者约定不明确的：面积误差比值在3%以内(含3%)，按照合同约定的价格据实结算，买受人请求解除合同的，不予支持。面积误差比值超出3%，买受人请求解除合同、返还已付购房款及利息的，应予支持。
