上海市普陀区人民法院认定，其产品将知名画作《永远进击》中鲁迅的香烟改为奶茶杯，构成实质性相似，侵犯了复制权、发行权及署名权、修改权等。判决赔偿原作者家属20万元并公开道歉。案件判决后，涉案公司不服提出上诉，后又撤回上诉，该案现已生效。
