传统“刺破公司面纱”是纵向的（股东对公司债务负责）。实践中出现了“横向刺破”的探索，即否认关联公司之间的独立人格，令其相互之间对债务承担连带责任。适用情形包括：关联公司人员、业务、财务高度混同，导致各自财产无法区分；或关联公司恶意利用独立人格逃避债务。最高法院在指导案例中对此持审慎肯定态度，要求必须达到“人格严重混同、严重损害债权人利益”的程度。
