美国“顶流杀手”出庭又火了！恐怖主义指控被驳回，全场粉丝欢呼庆祝……

大家还记得他吗？出生于富裕家庭，毕业于宾夕法尼亚大学，先后获得工程学学士和硕士学位的路易吉·曼吉奥内（Luigi Mangione），在去年26岁的时候，用一把3D技术打印的手枪，当街射杀联合健康保险公司CEO布莱恩·汤普森（Brian Thompson）。

在美国，医疗保险体系饱受争议：保费昂贵、理赔困难、药价高企。很多普通民众对大保险公司极度不满，认为它们“剥削病人、只顾盈利”。

而路易吉出生优渥，却选择和底层人民站在一起，反抗压迫，被美国网友称为“全民英雄”、“当代蝙蝠侠”。再加上他帅气的外形，落网被捕时，都能把橙色囚服，穿出爱马仕最新款的超绝时尚表现力，更是为他吸引了大批狂热追随者。

路易吉的入狱，牵动了很多人的心。终于在这个9月，路易吉又公开露面了，他身穿褐色囚服，戴着手铐和脚镣，被押送至纽约曼哈顿州法院出席庭审。

褐色囚服在他身上，完全没有沉闷感，反而被穿出了低调的高级感。现场的外国摄影师们早已按捺不住，一个比一个拼命按快门，就怕错过能秒杀同行的那一张路透。

言归正传，这次的庭审对于路易吉意义重大。法官驳回了纽约州对他的恐怖主义指控，但维持谋杀罪名。

A New York state judgedismissedon Tuesday two terrorism-related counts against Luigi Mangione over the December 2024 killing ofhealth insuranceexecutive Brian Thompson, though the 27-year-old remains charged with second-degree murder and eight other criminal counts in the case.

Justice Gregory Carro ruled that prosecutors had not presented enough evidence to the grand jury that Mangione acted with the intent to intimidate health insurance workers or influence government policy, which would have been necessary to prove murder as an act ofterrorism.

The judge set Mangione's next court date in the case for December 1.Mangione could still facelife in prisonif convicted of murder in the second degree, which is defined as an intentional killing.

The U.S. Justice Department is seeking thedeath penaltyin the federal case against Mangione. Carro's dismissal of the state-level terrorism counts has no bearing on the federal case.

美国司法部在联邦案件中正寻求对曼吉奥内判处死刑。而卡罗法官对州一级涉恐指控的驳回，并不会影响联邦案件的审理。

美国是联邦制国家，州法和联邦法是两套独立的法律体系：

1. 州法主要管辖本州范围内的普通刑事案件（如谋杀、抢劫）。

2. 联邦法适用于跨州、涉及国家利益、恐怖主义、金融欺诈、毒品走私等案件。

所以，一个行为既可能违反州法，也可能违反联邦法。州法院和联邦法院是独立审理的。所以虽然州法官驳回了涉恐罪名，但这不影响联邦政府继续追究死刑。

Echoing the scene at his last hearing, a few dozen supporters — mostly women — packed three rows in the rear of the courtroom gallery. Some were dressed in green, the color worn by the Mario Bros. video game character Luigi.

One woman sported a “FREE LUIGI” T-shirt. Across the street from the courthouse, cheers erupted from a pro-Mangione rally as news spread that the judge had dismissed his terrorism charges.

Outside the Manhattan Supreme Court on Tuesday a handful of Mangione's supporters gathered, some of them holding placards with slogans such as "Free Luigi" and "Innocent until proven guilty".

Mangione has attracted highly visible crowds of advocates to his court appearances as well as supporters online, who have fundraised hundreds of thousands of dollars for his defense against murder and other charges for the assassination-style shooting.

曼吉奥内的出庭持续吸引着大批公开支持者，线上也有不少人为他声援，甚至已为他筹集了数十万美元，用于应对谋杀等指控以及这起“暗杀式枪击”案件的辩护。
