按法定建制，乡镇政府是完整的一级地方人民政府，设有本级人大和政府班子。独立统筹辖区内的全部事务，管辖范围以农村区域为主，街道办则是市辖区或县级市政府的派出机关，并非一级政府，也不设本级人大。核心是落实上级部署的城市管理，社区服务等工作，管辖范围以城区社区为主，两者均为正科级建制，统一归所属区县党委政府领导，只是职能定位有区别。
