An Open Letter to the International Community from Jingye Steel Co., Ltd.

这是一封来自敬业钢铁有限公司（以下简称“敬业”）的致全球公开信。今天我们所谈的，远不止一家企业的得失，而是关乎国际规则、关乎合法投资者权益、关乎全人类共同契约精神的一场守护战。

Jingye Steel Co., Ltd. (‘Jingye’) issues this open letter to the international community. What is at stake today goes far beyond the gains and losses of a single company. It is a battle to defend the integrity of the international legal order, the legitimate rights and interests of investors, and the sanctity of contract.

五年前，英钢濒临破产，敬业毅然接手，仅一年即终结其九年亏损。五年间，敬业斥巨资进行产线升级、外包回收及高炉恢复，高峰期用工4887人，带动上下游约3万个就业岗位，累计发放薪酬及养老金10.25亿英镑、缴税1.8亿英镑。新冠疫情、英国脱欧、俄乌战争、能源危机接踵而至，敬业始终守诺如初，以实际行动持续为英钢及英国社会创造价值，彰显中国企业的责任与担当。

Five years ago, when British Steel stood on the brink of insolvency, Jingye decisively stepped in. Within a single year, it brought nine consecutive years of losses to an end. Over the following five years, Jingye invested substantial sums to upgrade production lines, bring previously outsourced operations back in-house and restore blast furnaces. At its peak, the direct workforce reached 4,887, while the business supported approximately 30,000 jobs across the wider supply chain. In total, Jingye paid £1.025 billion in wages and pensions and £180 million in taxes. Despite weathering the successive shocks of the Covid-19 pandemic, Brexit, the war in Ukraine and the energy crisis, Jingye remained true to its word, consistently creating value for British Steel and British society through concrete actions, thereby demonstrating the responsibility and commitment of a Chinese enterprise.

五年后的今天，英国政府以“公共利益”之名，未经协商、未经补偿，仅数小时便通过紧急立法，一纸法令便将敬业五年间投入的全部心血与资产尽数剥夺，悉数收归国有，至今未向敬业做出合理补偿。

Today, five years on, the UK Government has invoked “public interest” to pass emergency legislation in a matter of hours, without prior consultation and without compensation. With a single stroke of the legislative pen, it brought the entirety of the assets into state ownership, stripping Jingye of the fruits of five years of unwavering commitment and investment. To date, the UK Government has failed to offer Jingye any fair and reasonable compensation.

北京时间7月21日22时27分，敬业向全球发布正式声明，阐明事实真相与严正立场。短短数小时内，全球超千余家主流媒体自发全文转发，覆盖美、英、法、德、日等超45个国家，引发国际社会空前关注。此后数日，媒体持续追踪，民众声援不断。全世界都在问：法治的底线究竟在哪里？

At 22:27 Beijing time on 21 July, Jingye issued a formal statement to the international community, setting out the facts and its unequivocal position. Within a matter of hours, more than 1,000 major media organisations worldwide independently republished the statement in full. This coverage extended across more than 45 countries, including the United States, the United Kingdom, France, Germany and Japan, drawing unprecedented international attention. In the days that followed, media coverage continued and public expressions of support grew. The entire world is now asking: where, then, is the line that must not be crossed if the rule of law is to retain its meaning?

英国政府今日可如此对待敬业，明日便可如法炮制对待任何一个外来投资者。当政治需求可以凌驾于契约之上，当紧急立法可以剥夺合法财产而无须合理补偿，法治将失去根基，每一家跨国企业都可能成为下一个被剥夺的目标。

If the UK Government can treat Jingye in this manner today, it can easily do the same to any foreign investor tomorrow. When political expediency is permitted to override contractual obligations and emergency legislation can be used to deprive lawful owners of their property without fair and reasonable compensation, the rule of law loses its very foundation. Every multinational corporation risks becoming the next target of expropriation.

在此，敬业再次敦促英方正视国际法义务、尊重客观事实、履行法治承诺，及时、充分、有效赔偿敬业全部损失。这是对一家负责任企业最基本的交代，更是对国际法治底线应有的坚守。

Jingye therefore once again urges the United Kingdom to face up to its obligations under international law, respect the objective facts, honour its stated commitment to the rule of law, and provide prompt, adequate and effective compensation for the full extent of Jingye’s losses. This is the minimum redress owed to a responsible enterprise; more importantly, it is a necessary defence of the basic standards underpinning the international legal order.

敬业不会因受挫而退缩，更不会因强权而止步。这场官司，我们打到底；这份公道，我们争到底。乌云终将散去，强权压不垮真理。愿正义昭彰，法治永存！

Jingye will not retreat in the face of adversity, nor will it yield to coercion. We will see this case through to the end; we will pursue justice until justice is done. Dark clouds will pass, and power cannot silence the truth. May justice prevail, and may the rule of law endure.
