An environmental code will further forge a solid legal foundation for China to achieve modernization with harmony between humanity and nature, said Lou Qinjian, spokesperson for the fourth session of the 14th National People's Congress, at a press conference on March 4, 2026. Chinese lawmakers are set to deliberate on a draft environmental code during the session.

【知识点】

生态环境法典是我国第二部以“法典”命名的法律。2025年4月，生态环境法典草案整体亮相。2026年3月，生态环境法典草案提请十四届全国人大四次会议审议。

法典是新时代的法治标识。这部法典的编纂，不是简单的法律汇编，也不是完全的新立新定，而是对现有的生态环境法律制度机制和规则规范的系统整合、编订纂修、集成升华。

据介绍，法典的编纂主要包括三个方面：一是将现行的环境保护、污染防治方面的法律纳入法典，出台后不再保留原法律；二是现行的有关流域、区域、自然资源、生物多样性以及循环经济、节约能源等方面的法律制度规范，择其要旨要则体现到法典中；三是对于应对气候变化、碳达峰碳中和、绿色低碳发展等方面的法治需求，法典就此作出一些原则性、引领性规定，为今后我国相关法律制度建设留有空间，以体现法典的时代性、前瞻性。
